TERMS OF SERVICE

By accessing or using HarleyBids.com in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms apply to all visitors, bidders, consignors, and other users of the Site.

HarleyBids is operated by HarleyBids LLC, 1845 W Grand Ave, Chicago, IL 60622, USA.

You must be at least 18 years of age and legally capable of entering into a binding contract to place a bid on this platform. By bidding, you represent and warrant that you meet these requirements.

We reserve the right to refuse service to anyone for any reason at any time, including persons who have previously defaulted on a winning bid or engaged in misconduct.

Bids are binding

All bids placed on HarleyBids are legally binding offers to purchase. Once submitted, a bid cannot be retracted except in cases of documented material misrepresentation in the listing, at our sole discretion.

Bid increments

Each listing displays a minimum bid increment. Bids below the current highest bid plus the increment will not be accepted. There is no maximum bid.

Auction end times

Auctions end at the time displayed on the listing. HarleyBids reserves the right to extend an auction end time at its sole discretion (for example, to allow a bid to be confirmed). The displayed countdown is a guide and not a contractual guarantee of end time.

Reserve price

Some lots may carry an undisclosed reserve price. If the reserve is not met by auction close, HarleyBids reserves the right not to sell the lot. The highest bidder below reserve will be notified.

HarleyBids makes reasonable efforts to accurately describe each lot, including title status, mileage, known damage, and condition. However, all descriptions are provided for informational purposes only. Bidders are encouraged to inspect bikes in person and to conduct their own due diligence prior to bidding.

Photographs are taken at time of inspection. Condition may change between inspection and auction close. HarleyBids is not liable for minor discrepancies between photographs and actual condition.

Any errors or omissions in a listing, once discovered, will be corrected and active bidders notified. HarleyBids reserves the right to withdraw a lot at any time prior to settlement if a material error is found.

• Payment is due within 5 business days of winning unless otherwise agreed in writing.
• Accepted payment methods: bank wire transfer, certified check, or cashier's check.
• No credit cards, personal checks, or cryptocurrency.
• There are no buyer's premiums ”” the winning bid amount is the purchase price.
• Transport fees, if applicable, are separate and disclosed on each listing.
• Late payment may result in forfeiture of the lot and prohibition from future bidding.

Buyers are responsible for arranging and paying for transportation of the purchased vehicle. HarleyBids can provide referrals to trusted transport carriers at the buyer's request.

Collection in person is available by appointment at our Chicago location, Monday”“Saturday 9AM”“5PM. The buyer assumes all risk of loss and damage once the vehicle is released to the buyer or their carrier.

HarleyBids is not responsible for delays, damage, or loss that occurs during transport. Buyers should ensure adequate insurance coverage for transport.

Title will be transferred to the buyer upon receipt of cleared funds. All available title documentation will be provided. It is the buyer's sole responsibility to register the vehicle in their jurisdiction and comply with local laws regarding salvage, rebuilt, or non-running titles.

HarleyBids warrants only that the title documentation provided is the documentation we have received and inspected. We make no warranty regarding the ability to register the vehicle in any specific jurisdiction.

To the maximum extent permitted by applicable law, HarleyBids LLC and its officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill.

Vehicles are sold as-is, where-is. Except as expressly stated in the listing, HarleyBids makes no warranties, express or implied, regarding the condition, fitness for purpose, or merchantability of any vehicle.

HarleyBids' total liability to you for any claim arising from these Terms shall not exceed the amount paid by you in connection with the transaction giving rise to the claim.

You agree not to:

• Place bids you do not intend to honor
• Engage in shill bidding or bid manipulation
• Harass, threaten, or abuse our staff or other users
• Attempt to circumvent our systems or access our systems without authorisation
• Use the Site for any unlawful purpose
• Misrepresent your identity or contact information when bidding
• Interfere with other bidders' ability to participate in auctions

Violations may result in immediate suspension, reporting to law enforcement, and legal action.

HarleyBids reserves the right to terminate or suspend access to any user, for any reason, at any time, with or without notice. Reasons include but are not limited to: non-payment, bid retractions, abusive behaviour, or suspected fraud.

All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, United States of America, without regard to conflict of law provisions.

Any disputes arising from these Terms or your use of HarleyBids shall be resolved in the state or federal courts located in Cook County, Illinois, and you consent to the exclusive jurisdiction of such courts.

HarleyBids reserves the right to modify these Terms at any time. We will notify users of material changes by posting a notice on the homepage or sending an email to the address on record. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
